Legal Notice of Fire Dues Increase Effective 1-1-2026

ADMENDMENT TO SECTION I, II, III, IV, VII, and XIII OF AN ORDINANCE TO PROVIDE FOR THE LEVY OF SERVICE CHARGES BY AND FOR FORESTDALE FIRE DISTRICT – ADOPTED OCTOBER 27, 2025

 

The following provisions shall become effective January 1, 2026 unless the petition required by section 13 of Act 79 of the 1966 Special Session of the Legislature of Alabama is filed within 30 days of this advertisement.

 

DEFINITIONS

Multi-Residential Property

For the purpose of this schedule of service charges the term “multi-residential property” shall mean apartment, apartment unit in an apartment building, duplex, detached garage apartment, nursing home/assisted living, motels/hotels, located within a licensed mobile home park – camper, mobile home or duplex :

  1. which is constructed for occupation as a residence whether occupied as personal residence by the landowner, or unoccupied by the landowner but maintained for non-commercial personal purposes by the landowner, or
  2. which is operated, maintained or used for residential rental purposes, or for any multi-residential purposes whatsoever, and whether or not occupied; or
  3. which has existing on January 1 of the subject year, any part of a wall of the said multi-residential property
  4. Assisted living unit shall mean a unit containing living accommodations for not more than one family in a building or structure containing more than one unit
  5. Nursing home bed shall mean a bed located in a facility designed for the care of the medically or physically handicapped or the elderly, in a building or structure containing more than one unit
  6. Mobile Home Park Lot shall mean an area or lot which is created under a business license for the placement of one manufactured home unit.

 

The term “multi-residential property” includes all outbuildings, such as garages, sheds, stables, and campers, which are used in conjunction with the multi-residential, but not used for on-site rental as a separate residence.

 

 

Commercial Property

For the purpose of this service charge schedule, the term “commercial property” shall mean any and all real property for commercial purposes, whether occupied or not; whether permanent or temporary including, but not limited to, stores, restaurants, service stations, repair businesses, greenhouses, nurseries, office buildings, sales office buildings, office or storage area for multi-residential complexes, manufacturing and assembly plants, airports, night clubs, warehouses, mines, and quarries.

  1. Square feet shall mean the number of square feet of floor space, including storage or work space, used in connection with the business
  2. Business unit shall mean a building, or some part of a building, or open area designed or used for the conduct of a business therein that requires a county/state business license.

Pursuant to Section 13 of Act No. 79 of the Special Session of the Legislature of Alabama 1966, as amended, service charges for the Forestdale Fire District shall be as hereinafter described:

  1. Unimproved Real Property
  • The service charge for any unimproved parcel of real property shall be based on the current Market Value as determined by the Jefferson County Tax Assessors Office for tax purposes and/or the Board of Equalization. These service charges shall be assessed as follows:

Current Market Value multiplied by .002 = Total Service Charge

  • The minimum charge for unimproved Real Property shall be $25.00.
  • The maximum charge for unimproved Real Property shall be $ 250.00.
  • For the purpose of this service charge schedule for Unimproved Real Property, all contiguous Parcels owned by the same entity shall be combined and considered as one Parcel.

 

  1. Single Residential and Other Property

The service charges shall be assessed as follows:

Single Family House                                                              $353.00

Townhouse or condominium, per unit                                    $280.00

Camper                                                                                  $280.00

Single-wide manufactured home                                           $280.00

Double-wide manufactured home                                          $353.00

Garage, barn, shed, stable, outbuilding and the like             $122.00

New construction, reconstruction, remodeled or damaged structures shall be subject to this fee schedule if any wall or part of a wall of any level of the structure is in place during any part of the calendar year.  If the new construction, reconstruction, remodeled or damaged structures or any wall or part of wall of any level of the structure is in place between January 1 and June 30th the full service charge shall apply.  If the new construction, reconstruction, remodeled or damaged structures or any wall or part of wall of any level of the structure is in place on or after July 1st a prorated charge of one-half (1/2) of the service charge shall be assessed.

 

III. Multi-Residential Property

The service charge for multi-residential property shall be assessed as follows:

 

Each Apartment unit (including Duplex’s)         $224.00

Each Assisted Living unit                                  $224.00

Each Nursing Home Bed                                  $180.00

Motel/Hotel Room                                             $150.00

Each Mobile Home Park Lot – Single               $280.00

Each Mobile Home Park Lot – Double              $353.00

Each Mobile Home Park Lot – Duplex              $224.00, per living unit

 

Mobile Home Park Lots – Single, Double or Duplex, shall only be charged if during the immediately preceding year a structure or part of a structure is located on the lot as verified by the Forestdale Fire District.

New construction, reconstruction, remodeled or damaged structures shall be subject to this fee schedule if any wall or part of a wall of any level of the structure is in place during any part of the calendar year.  If the new construction, reconstruction, remodeled or damaged structures or any wall or part of wall of any level of the structure is in place between January 1 and June 30th the full service charge shall apply.  If the new construction, reconstruction, remodeled or damaged structures or any wall or part of wall of any level of the structure is in place on or after July 1st a prorated charge of one-half (1/2) of the service charge shall be assessed.

 

 

  1. Commercial Property

The service charge for commercial property shall be based on the square footage as determined by the District. The service charges shall be assessed as follows:

 

For Each business unit for      0 to 1,000 sq. ft. floor space               $   477.00

For Each business unit for      1,001 to 3,000 sq. ft. floor space        $   906.00

For Each business unit for      3,001 to 5,000 sq. ft. floor space        $1,335.00

For Each business unit for      5,001 to 7,000 sq. ft. floor space        $1,764.00

For Each business unit for      7,001 to 9,000 sq. ft. floor space        $2,193.00

For Each business unit for      9,001 to 11,000 sq. ft. floor space      $2,622.00

For Each business unit for      11,001 to 13,000 sq. ft. floor space    $3,051.00

For Each business unit for      13,001 to 15,000 sq. ft. floor space    $3,480.00

For Each business unit for      15,001 to 17,000 sq. ft. floor space    $3,909.00

For Each business unit for      17,001 to 19,000 sq. ft. floor space    $4,338.00

For Each business unit for      19,001 to 21,000 sq. ft. floor space    $4,767.00

For Each business unit for      21,001 to 23,000 sq. ft. floor space    $5,196.00

For Each business unit for      23,001 to 25,000 sq. ft. floor space    $5,625.00

For Each business unit for      25,001 to 27,000 sq. ft. floor space    $6,054.00

For Each business unit for      27,001 to 29,000 sq. ft. floor space    $6,483.00

For Each business unit for      29,001 to 31,000 sq. ft. floor space    $6,912.00

For Each business unit for      31,001 to 33,000 sq. ft. floor space    $7,341.00

For Each business unit for      33,001 to 35,000 sq. ft. floor space    $7,770.00

For Each business unit for      35,001.to 37,000 sq. ft. floor space    $8,199.00

For Each business unit for      37,001 and greater sq. ft. floor space $8,628.00

New construction, reconstruction, remodeled or damaged structures shall be subject to this fee schedule if any wall or part of a wall of any level of the structure is in place during any part of the calendar year.  If the new construction, reconstruction, remodeled or damaged structures or any wall or part of wall of any level of the structure is in place between January 1 and June 30th the full service charge shall apply.  If the new construction, reconstruction, remodeled or damaged structures or any wall or part of wall of any level of the structure is in place on or after July 1st a prorated charge of one-half (1/2) of the service charge shall be assessed.

 

 

VII   Special Taxed Property

 

  • The service charge for public schools, churches, other civic organizations, government buildings, and non-profit organizations, as approved by the Board of Trustees shall be as follows:

 

For each School Building                                             $385.00

For each Church building                                             $385.00

For each Church daycare                                            $385.00

For each Church school                                               $385.00

For each lodge, pool, or community center                 $385.00

New construction, reconstruction, remodeled or damaged structures shall be subject to this fee schedule if any wall or part of a wall of any level of the structure is in place during any part of the calendar year.  If the new construction, reconstruction, remodeled or damaged structures or any wall or part of wall of any level of the structure is in place between January 1 and June 30th the full service charge shall apply.  If the new construction, reconstruction, remodeled or damaged structures or any wall or part of wall of any level of the structure is in place on or after July 1st a prorated charge of one-half (1/2) of the service charge shall be assessed.

 

XIII. Miscellaneous Fees  

The service charge for the duplication of fire reports shall be assessed at $10.00 per copy. This includes any and all reports related to structure fires. Property owners shall be entitled to two report copies at no charge.

The service charge for the duplication of medical reports shall be assessed at the amount reasonable and customary for such services within our geographical area and as allowed by the Statutes of the State of Alabama Code 1975 Sec 12-21-6.1.

The service charge related to title letters issued to real estate attorneys shall be assessed at the amount reasonable and customary for such services within our geographical area.

 

This Amended Ordinance shall not become effective until the following have occurred:

  1. Until the substance of the Ordinance has been published in a newspaper of general circulation in the district.
  2. Eight days have elapsed after such publication and eight days have also elapsed after the posting of the Ordinance in full view in Forestdale Fire District stations located at 1485 Forestdale Blvd, Birmingham, AL 35214; 751 Heflin Avenue East, Birmingham, Alabama 35214; and 341 Foust Ct. Birmingham, Alabama 35214.
  3. Thirty (30) days have elapsed following the newspaper publication of the ordinance, provided for the above, without the petition for an election being filed with the Probate Judge of Jefferson County, Alabama, as provided for in Section 12 of Act 79, Special Session for the Legislature of Alabama 1996, as amended.
